1. Formation of contract
1.1 No Contract comes into existence until the Customer’s order has been accepted by Autohoist Australia and such acceptance has been received by the Customer. The Contract is deemed to be concluded at the time and place where such acceptance is received by the Customer.
1.2 The products sold and/or services rendered are subject to these Terms and Conditions to the exclusion of any other terms and conditions. The Customer acknowledges that it is aware of the contents of and agrees to be bound by these Terms and Conditions.
2. Payment
2.1 Unless credit terms have been expressly agreed by Autohoist Australia, payment for the Products and/or services must be made in full before physical delivery of Products and/or services.
2.2 The Customer will pay for all applicable shipping and handling charges.
2.3 The Customer will bear all country, provincial, government, state and local sales, use, goods and services, value added, excise, privilege and similar levies/taxes.
2.4 The purchaser acknowledges that it will be his/her/their responsibility to obtain/comply with all public authority’s requirements and any costs associated with this will be at the purchasers expense.
2.5 Time for payment is of the essence. Autohoist Australia reserves the right to charge interest at the rate of 2% above the base commercial floating rate for Commonwealth Bank of Australia.
3. Title and risk
3.1 Title to and risk in the Products passes to the Customer upon payment from the Customer.
3.2 The Customer has 24 hours after delivery of goods in which to notify Autohoist Australia Pty Ltd in writing of any damage or shortage to the Product. Any visible damage upon delivery is to be noted on the carriers consignment note, failure to do so will result in refusal of any claims.
4. Delivery
4.1 Autohoist Australia will deliver the Products to the shipping address or nearest depot- for collection by the customer. The customer is responsible for supplying unloading facilities eg. a fork lift, unless otherwise prearranged with Autohoist Australia.
4.2 For the efficiency of Autohoist Australia’s fulfilment procedures, it may be necessary for Autohoist Australia to deliver the Products by instalments in any sequence.
4.3 Any dates provided by Autohoist Australia for the delivery of the Products are estimates only and will not form part of the Contract. Actual delivery date will be affected by factors such as clearance of payment, Customer’s location and availability of the Products. Autohoist Australia will not be liable for any delay in delivery of the products and/or services, howsoever caused.
4.4 Autohoist Australia has a policy of on-going Product update and revision. As a result, Autohoist Australia may revise and/or discontinue Products at any time without notice.
4.6 Where Products ordered have been revised and/or discontinued, Autohoist Australia will supply revised or updated Products with the same or better functionality and performance of the Products ordered. The Customer accepts that Autohoist Australia’s policy may result in differences between the specification of Products delivered to the Customer and the specification of Products ordered.
5. Business usage
5.1 Goods and/or services supplied by Autohoist Australia are for business usage only. They are not intended for personal, domestic or household usage.
5.2 The Customer warrants to implement appropriate means and procedures to ensure operational continuity of the business in the event that the Product experiences any performance failures. This may include disaster recovery plans.
6. Special Terms for Clearance Items
Items listed in the Clearance category on this site are sold on an “as is” basis. They may include products refurbished, seconds, damaged during transit, have missing components or otherwise not be sale-able as brand new. Whilst we endeavour to list all defects for items listed within this category there may be defects not apparent until the goods are unpacked and installed/operated by the end user. By purchasing an item listed in the Clearance category you agree it is supplied on an “as is” basis with no refunds/returns or any further discounts applicable.
7. Liability
For goods Autohoist Australia’s total liability in respect of each event or series of connected events will not exceed the total price paid for the purchase of products and/or services under these Terms and Conditions.
These Terms and Conditions are governed by and construed in accordance with the laws of Queensland and are subject to the non-exclusive jurisdiction of the courts of Queensland.
